Terms of Service
These Terms govern your use of the Arkdemics app, operated by JMB LLC ("Arkdemics," "we," "us"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. Eligibility and accounts
You must be at least 17 years old to use Arkdemics. You are responsible for your account and for keeping your login secure. Provide accurate information and keep it up to date.
2. What Arkdemics is — and what it is not
Arkdemics is a skill-development and coaching community for welders. Feedback in the app — whether crowd polls or mentor coaching — is training guidance only. It is not a certified weld inspection, non-destructive examination, engineering advice, or an acceptance decision under any welding code. Never rely on it where safety, code compliance, or structural integrity matters. Welding is hazardous; you are responsible for your own safety, PPE, and following your shop or site procedures.
3. Acceptable use
- Post only weld photos you have the right to share. Do not upload other people's work as your own, or content that is unlawful, abusive, or infringing.
- Do not misuse the community features, attempt to disrupt the service, or circumvent moderation, payments, or the mentor marketplace.
- Flagged content is reviewed; repeated violations can result in content removal, strikes, or a ban at our discretion.
4. Mentors and 1:1 sessions
Mentors are credential-verified independent users, not employees of Arkdemics. A 1:1 session is coaching on your welding; it is not certification or inspection. Mentors set their own session rate within the allowed range. Arkdemics facilitates the connection and the payment and charges a platform fee on each session. Mentors receive their share through Stripe, which handles their payouts and applicable tax reporting. You agree not to arrange payment outside the app to avoid fees.
5. Payments, subscriptions, and refunds
- Subscriptions (such as Journeyman) are billed through the app store and auto-renew until canceled. Manage or cancel them in your device's subscription settings. Subscription refunds are handled by the app store under its policies.
- Mentor sessions are paid in the app through Stripe. Because a session is a service delivered by a person, fees for a completed or in-progress session are generally non-refundable. If something goes wrong, contact us and we will review it in good faith.
- Prices and fees may change; changes apply going forward, not to purchases already made.
6. Your content and license
You keep ownership of the content you post. You grant Arkdemics a non-exclusive license to host and display your content in the app and to use anonymized poll and feedback data to operate and improve the product. You are responsible for the content you submit.
7. Disclaimers
Arkdemics is provided "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that feedback will be accurate or suitable for any purpose.
8. Limitation of liability
To the fullest extent permitted by law, JMB LLC and Arkdemics will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of the app or reliance on any feedback. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
9. Indemnification
You agree to indemnify and hold harmless JMB LLC and Arkdemics from claims arising out of your content, your use of the app, or your violation of these Terms.
10. Termination
You may stop using Arkdemics and delete your account at any time. We may suspend or terminate access for violations of these Terms or to protect the community.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
12. Changes to these Terms
We may update these Terms. We will post the updated version here and change the "Last updated" date. Continued use after changes means you accept them.
